Der Einsatz empirischer Forschungsmethoden in der Medizinethik hat zu Forderungen nach einem gewandelten Selbstverständnis der Medizinethik geführt, die sich mehr als eine integrierte Disziplin aus Sozialwissenschaften und Ethik verstehen solle. Dagegen wird hier die These vertreten, dass über Sinn und Unsinn des Einsatzes empirischer Methoden zunächst eine moralphilosophische Diskussion erforderlich ist. Medizinethiker müssen ausweisen können, welche empirischen Forschungsresultate zur Beantwortung normativer Fragen erforderlich sind. Ein solcher Ausweis beruht seinerseits jedoch auf normativen Annahmen, die ihrerseits moralphilosophischer Legitimation bedürfen. Der Beitrag untersucht (...) daher den Einsatz empirischer Methoden in der Medizinethik im Hinblick auf Verhältnis von ethischem Grundlagendiskurs und Methodologie der angewandten Ethik. Während die terminale Sedierung neueren niederländischen Erhebungen zufolge bereits in mehr als 5% aller Sterbefälle zur Leidensminderung am Lebensende angewandt wird, sind viele der durch dieses Verfahren aufgeworfenen begrifflichen und ethischen Fragen weiterhin offen. Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. Life is a series of inputs, procedures, and outputs that shape an individual’s personality. The role of work is not limited to providing a material and moral resource only. An individual with the drive to achieve can overcome the challenges he will face, perform the tasks required of him, and struggle for success (Bani Younis, 2009, p. 3). Once the reporter joins the work, he sets goals to achieve. Some try to increase their knowledge and develop their skills, there are (...) those who seek to achieve distinction and mastery, there are those who only want to work, and there are those who have no motivation or achievements (Harackiewicz, & et al, 1998, p. 638). Some correspondents make mistakes as a result of weak professional awareness and the absence of a language for communicating with others, for reasons including habituation to following the familiar and submitting to the experienced, which leads to poor task accomplishment, weak ambition, and failure to achieve oneself until the correspondent becomes unable to confront situations and overcome obstacles (Sweller, 2014, p: 19). Man is naturally a social being who tends to share ideas, achievements, and experiences with others. This is the way successful people in life are distinguished by professional awareness and openness to others (Hammoud, 2014, p. 45). The achievement motive is qualitative knowledge, not quantitative. The correspondent who reaches the appreciation of his superiors must achieve himself and feel satisfied (Bani Mufrej, 2009, p. 4). (shrink)

To say that the liturgy is a question of faith means that your object is transcendent and has to do with God and with one unique feature, ie, the very act of celebrating an act of faith. The liturgy is not only motivated by faith, but it is their faith in words, which is a very peculiar dimension.

Ethical conflicts have always been connected with new techniques of reproductive medicine such as in-vitro fertilization. The fundamental question is: When does human life begin and from which stage of development should the embryo be protected? This question cannot be solved by scientific findings only. In prenatal ontogenesis there is no moment during the development from the fertilized oocyte to a human being which could be recognized as an orientation point for all ethical problems connected with the question of the (...) right to dispose of prenatal life (interruption of pregnancy, research on embryos). The protection of an individual human life must be valid for all in the same manner and from the very beginning on. It must not depend on value judgments or on stages of development, so-called grades of humanity, because these would then become selection criteria. Procreated life must have the right to be born. These were the essential ethical arguments which led to the German Embryo Protection Law. (shrink)

Versuche zur Geschlechtswahl bei der Befruchtung führten in jüngerer Zeit zu anwendbaren, wenngleich noch eingeschränkt erfolgssicheren Techniken. Deren ethische und rechtliche Bewertungen stehen im Mittelpunkt dieser Abhandlung. In Gesellschaften und Kulturen mit traditioneller Bevorzugung männlicher Nachkommenschaft gibt es einerseits ein starkes Interesse für die Geschlechtswahl, andererseits wird in einigen westlichen Ländern der vorgeburtlichen Geschlechtswahl sehr geringe praktische Bedeutung beigemessen. Dabei unterscheidet sich die Verfügbarkeit der entsprechenden reproduktionsmedizinischen Verfahren von freier Zugänglichkeit zu allen Methoden (Präimplantationsdiagnostik, Spermatozoentrennung usw.) des Fortpflanzungsmedizinmarkts (USA) bis (...) hin zu strenger Reglementierung (Deutschland). Es wird anhand der wissenschaftlichen Literatur der Frage nachgegangen, welche für die Begründung rechtlicher Regelung beachtlichen sozialen oder gesundheitlichen Gefährdungen durch präkonzeptionelle Geschlechtswahl verursacht werden könnten, und welche Gründe es andererseits für die Zulässigkeit sozial motivierter präkonzeptioneller Geschlechtswahl gibt. Patientenmobilität und grenzüberschreitende Gesundheitsversorgung sind alltägliche Phänomene in der Europäischen Union (EU). Im Jahr 2011 hat die EU eine Richtlinie erlassen, um in diesem Kontext Rechtssicherheit herzustellen. Bisher gibt es keine umfassenden systematischen Studien über ethische Aspekte grenzübergreifender Gesundheitsversorgung. In dieser Arbeit werden die rechtlichen Entwicklungen der grenzübergreifenden Gesundheitsversorgung dargestellt und die in der Literatur vereinzelt erwähnten ethisch relevanten Aspekte heuristisch und auf Patiententypologien aufbauend systematisch inventarisiert und diskutiert. Es zeigt sich, dass die Möglichkeit der Patientenmobilität und die damit vor (...) allem verbundenen Finanzierungsregelungen die Autonomie einiger Patienten sicherlich verbessern kann. Allerdings können wohl nicht alle Patienten Versorgungsverbesserungen erwarten. Im Gegenteil können sogar negative Konsequenzen für einige Patienten folgen, was vor allem aus gerechtigkeitstheoretischen Überlegungen kritisch zu sehen ist. (shrink)

This study uses a qualitative discourse analysis approach to investigate Pakistani female politicians' discursive representation in print and electronic media. Specifically, the research focuses on the narratives and framing strategies employed by the media to construct and portray the public image of these political figures. By employing Corpus-Assisted Diachronic Discourse Analysis (CADDA), the study traces the changes in media discourse over time, uncovering how gender biases, societal norms, and power dynamics shape the representation of women in Pakistani politics. The findings (...) reveal significant trends in gendered framing, highlighting how media portrayal fluctuates between marginalization and recognition of female politicians' contributions, though gender stereotypes remain deeply embedded in these narratives. The findings of this study have important implications for future media reform initiatives, advocating for a more equitable and balanced representation of women in politics. The insights gained can also inform gender advocacy strategies and policy efforts to enhance women's visibility and leadership roles in traditional and digital media. (shrink)

This paper aims to investigate the current state of play on Environmental Social and Governance (ESG) integration and check the validity of the current metrics system by assessing if it will survive the COVID-19 crisis. By adopting a qualitative research approach through semi-structured anonymous interviews with 14 senior managers of six European listed companies we use a framework by assessing the mechanisms of reactivity on the effectiveness of ESG measures in times of COVID-19. By interpreting the practitioners’ points of view (...) through the lens of the sociological framework by Espeland and Sauder (Am J Sociol 113:1–40, 2007) our findings show different mechanisms of reactivity by companies on the effectiveness of ESG measures in times of COVID-19, i.e., active and passive conformity and active resistance. We also identified the main Corporate Social Responsibility (CSR) institutional factors that affect managers’ reactivity. An extensive re-formulation of the ESG metrics is required in the light of times of crisis, given that accountability and transparency are strongly linked to quantitative measures which can play a critical role in the financial system and investors’ engagement. Particularly, the strict distinction between “E”, “S” and “G” issues should be abandoned claiming a different holistic re-design of sustainability measures by considering the increasing relevance of the Social dimension in time of COVID-19. This study provides a valuable contribution to the existing literature on the measurement of sustainability within the link of accountability and crisis by highlighting new corporate needs to re-design the ESG metrics system. Der Beitrag fragt nach dem Stellenwert des Normalitätsbegriffs im Diskurs der Behinderung. Ausgangspunkt ist die These, dass Normalität und Normativität analytisch voneinander getrennt werden müssen. In der heutigen Normalisierungsgesellschaft existieren sowohl wertbezogene, präskriptive ("normative") als auch statistisch fundierte, deskriptive ("normalistische") Normen. Außerdem lassen sich zwei Normalisierungsstrategien kennzeichnen: ein starr ausgrenzender, normierender Ansatz ("Protonormalismus") und eine flexible, normalisierende Strategie ("flexibler Normalismus"). Auf dieser theoretischen Folie wird diskutiert, ob sich im behindertenpolitischen Diskurs und in sozialpolitischen Konzepten Tendenzen der flexiblen Normalisierung auffinden lassen. (...) Der Schwerpunkt des Beitrags liegt auf einer normalitätstheoretischen Analyse der beiden Klassifikationsmodelle der Weltgesundheitsorganisation. Die "International Classification of Impairments, Disabilities and Handicaps" (ICIDH 1980) blieb noch der wertbezogenen Normativität verhaftet. Dagegen stellt die "International Classification of Functioning, Disability and Health" (ICF 2001) die normalistische (Vergleichs-)Norm ins Zentrum und formuliert das Gebot der Selbstnormalisierung. In 2016, the Five Stars Movement (5SM), one of the parties currently in power in Italy, launched the ‘Rousseau platform’. This is a platform meant to enhance direct democracy, transparency and the real participation of the people in the making of laws, policies and political proposals. Although ennobled with the name of Rousseau, the 5SM’s redemptive promise has been strongly criticised in the public sphere for being irresponsible and ideological. Political realism, I will argue, can perform both a diagnostic and (...) a corrective task, by providing some tools to unveil populist distortions and by offering more solid grounds for political opponents’ critique. Three aspects of realism, in particular, will be pointed out as remedies against populist drifts. First, anti-moralism, complemented by anti-utopianism and contextualism, criticises the populists’ moralistic picture of politics, its anti-pluralistic attitude and its rejection of the role of experts in politics. Second, the Weberian ethic of responsibility offers standards to assess politicians’ actions, instead of embracing the populist aversion towards any professional politician; besides, it contrasts the populist image of politics as a derogatory activity. Finally, realism as ideology critique unveils the distorting narratives underlying populist propaganda and fostering uncritical support. (shrink)

This paper problematizes the precision medicine approach embraced by the All of Us Research Program (US) and by Genomics England (UK) in terms of benefits distribution, by arguing that current “diversity and inclusion” efforts do not prevent exclusiveness, unless the framing and scope of the projects are revisited in public health terms. Grounded on document analysis and fieldwork interviews, this paper analyzes efforts to address potential patterns of exclusion upstream (from participating in precision medicine research) and downstream (from benefitting from (...) precision medicine outputs). It argues that efforts for inclusion upstream are not corresponded downstream, and this unbalance jeopardizes the equitable capacities of the projects. It concludes that enhanced focus on socio-environmental determinants of health and aligned public health interventions as precision medicine outputs would be to the benefit of all and especially of those who are most at risk of (upstream as well as downstream) exclusion. Computational models of legal precedent-based reasoning developed in AI and Law are typically based on the simplifying assumption that the background set of precedent cases is consistent. Besides being unrealistic in the legal domain, this assumption is problematic for recent promising applications of these models to the development of explainable AI methods. In this paper I explore a model of legal precedent-based reasoning that, unlike existing models, does not rely on the assumption that the background set of precedent cases is (...) consistent. The model is a generalization of the reason model of precedential constraint. I first show that the model supports an interesting deontic logic, where consistent obligations can be derived from inconsistent case bases. I then provide an explanation of this surprising result by proposing a reformulation of the model in terms of cases that support a new potential decision and cases that conflict with it. Finally, I show that the reformulation of the model allows us to verify that inconsistent case bases do not make verification that a decision is permissible substantially more complex than consistent case bases and to introduce intuitive criteria to compare different permissible decisions. Victoria S. Harrison’s theory of internal pluralism approaches religious beliefs in terms of conceptual schemes. To her, this approach has the advantage of preserving core pluralist intuitions without being challenged by the usual difficulties. My claim is that this is not the case. After providing a succinct presentation of internal pluralism, I show that the critique of traditional pluralist views such as Hick’s may also be addressed to Harrison. There are two main reasons in support of my claim. Firstly, a (...) believer’s common understanding of religious experiences conflicts with the way in which internal pluralism understands religious belief. Such conflict implies that if internal pluralism were a sound theory, most religious beliefs would turn out to be false, and, contrary to Harrison’s intention, they would be rendered cognitively irrelevant. Secondly, internal pluralism excludes the possibility of religious disagreements. By applying to religions an epistemological approach based on conceptual schemes, doxastic dissent is actually dismantled at the cost of developing an entirely solipsistic reading of religious beliefs. In the final section of my paper, I will show that such unattractive features are consequences of the notion of conceptual scheme. (shrink)

Most literature on religious disagreements focuses on the epistemic problems related to doctrinal disputes. While, the main argument of my paper does not address such a topic, my purpose is to point at a practical exit strategy from the blind spot to which most disagreements lead. However, in order to argue for my views, I need to provide a substantive account of how religious beliefs work and which epistemic obligations they involve. Such account challenges most mainstream assumptions, and needs to (...) be developed in some details. My method consists, then, in construing a theory for religious beliefs, and exploring its consequence concerning disagreements. I will focus particularly on the positive task. My paper argues for the claim that religious experience may provide evidential reasons in support of religious beliefs. I name such a claim epistemic view of mystical experience (EM). In the first section, I sketch two approaches to EM. Swinburne, Alston and Plantinga (among others) develop a notable defense of EM. On the contrary, seminal works by Feuerbach and Bultmann offer the opposite account. I briefly show how to resist to the criticism of EM. In light of such line of (...) reasoning, I move to Alston's Theory of Doxastic Practices (TDP) in the second section. After giving a skeletal account of TDP, I construe an argument in Alstonian terms against the naturalist refutations of EM. In the third section, I highlight the main problem with TDP, that is, the claim that perceptions and religious experiences have an analogical relation. Examples from sacred texts of different traditions show that such a claim fails to grasp what a religious experience is. In the final section I give a preliminary account of the notion of presentational experience, and show that it is possible to defend EM more plausibly than TDP does by the use of this notion. This book presents a novel analysis of concealed-question constructions, reports of a mental attitude in which part of a sentence looks like a nominal complement, but is interpreted as an indirect question. Such constructions are puzzling in that they raise the question of how their meaning derives from their constituent parts. In particular, how a nominal complement, normally used to refer to an entity ends up with a question-like meaning. In this book, Ilaria Frana adopts a theory according to (...) which noun phrases with concealed question meanings are analysed as individual concepts. The traditional individual concept theory is modified and applied to the phenomena discussed in the recent literature and some new problematic data. The end result is a fully compositional account of a wide range of concealed-question constructions. The exploration of concealed questions offered in the book provides insights into both issues in semantic theory, such as the nature of quantification in natural languages and the use of type shifter in the grammar, and issues surrounding the syntax-semantics interface, such as the interpretation of copy traces and the effects on semantic interpretation of different syntactic analyses of relative clauses. The book will interest scholars and graduate students in linguistics, especially those interested in semantics and the syntax-semantics interface, as well as philosophers of language working on the topic of intensionality. As part of the laboratory activities designed for the students of the second year of the Mathematical High School by the research group in Mathematics Education of the Department of Mathematics of the University of Salerno, the theme “From Archimedes and the oxen problem to Pell’s equation” has been designed. The course has not yet been delivered to students and in this paper the didactic path to be developed in the classroom will be described. The students initially will retrace the (...) various solution approaches proposed over the centuries. Subsequently, with a heuristic approach, they will tackle the resolution of the proposed problem by exploiting properties related to the theory of numbers. With the help of some schedules, provided by the teachers-tutors, they will conjecture and argue by answering questions aimed at stimulating didactic reflection. This workshop path involves processes such as exploring and conjecturing through the articulation of different ways of working (individual and in groups), manual and digital. (shrink)

This study aims to extract and put in evidence the possible senses of ‘limit’ (πέρας) in Damascius’ thought. First, I focus on the meaning of limit as boundary within which the dialectic is functional. Next, I consider a second meaning of limit as forbidding to explore ungraspable matters due to their transcendent status. A third meaning of ‘limit’ is analysed in the light of the possible connection of Damascian speculation with Kant’s Criticism and transcendental reflection. Subsequently, I explore the concept (...) of ‘rashness’ (προπέτεια) that Damascius opposes to the self‑limiting faculty of the λόγος. The excursus on the term προπέτεια starts from Aristotelian observations on the object and then concentrates on the hypothesis of the sceptical derivation of this concept to criticise dogmatising metaphysics. The second part of the paper reflects on Damascus’ ‘philosophy of the limit’ in relation to some issues extracted from Marilena Vlad’s volume Damascius et l’Ineffable. Particular attention is directed at the paradiscursive forms presented by the author, insofar as they express an attempt to overcome the extreme limit of logical‑propositional thinking. In this context, I discuss the suggestiveness of intelligence that is connected to the formulation of endeictic metaphysics as a dialectical mode of surpassing the limit. In conclusion, I suggest that one can speak of crossing the limit not only in terms of exceeding, but rather of transcending the restrictive dynamics of ordinary knowledge. (shrink)

This book analyses Eriugena’s Christian Platonic ideas on theology, cosmology, anthropology, epistemology, and ethics, and their sources in Patristic philosophical theology and ancient philosophy. The first part is devoted to Eriugena’s theology: thus, it focusses on God from a variety of perspectives, some of them also comparative in their nature. The second part consists in research into Eriugena's cosmology, anthropology, and ethics, including virtue ethics. The two large sections are interrelated by an exploration of Eriugena's concepts of apokatastasis and epistrophé, (...) in his great theory of the movement of all "from God to God". (shrink)

Some realists in political theory deny that the notion of feasibility has any place in realist theory, while others claim that feasibility constraints are essential elements of realist normative theorising. But none have so far clarified what exactly they are referring to when thinking of feasibility and political realism together. In this article, we develop a conception of the realist feasibility frontier based on an appraisal of how political realism should be distinguished from non-ideal theories. In this realist framework, political (...) standards are feasible if they meet three requirements: they are politically intelligible, contextually recognisable as authoritative, and contestable. We conclude by suggesting that our conception of realist feasibility might be compatible with utopian demands, thereby possibly finding favour with realists who otherwise refuse to resort to the notion of feasibility. The debate on bottom-up approaches in political theory has been recently enriched by Jonathan Floyd’s “normative behaviourism”, an approach that starts from and refers to actual behaviours so as to let normative concerns emerge and political responses be found. Despite its merits, I argue that normative behaviourism suffers from three weaknesses: the _tip of the iceberg_, the _invisibility_, and the _over-inclusive justification_ problems. These problems emerge because behaviours can be normatively significant only when the beliefs behind those behaviours are known. (...) To overcome these problems, I suggest a “revised” version of normative behaviourism, which makes use of focus groups to reach two objectives: first, to understand the beliefs driving behaviours; and, second, to filter out unacceptable beliefs that might lead to inappropriate political solutions when their corresponding behaviour is considered normatively relevant for institutional reform. While revised normative behaviourism is still at the stage of a drafted proposal, it has the potential to pave a way for data collection to contribute to the very _formulation_ of normative standards rather than just to the identification of practical constraints to the _application_ of normative standards. Determinism is the view that any event is determined by previous events and the laws of nature. My claim is that Plotinus's, Leibniz's and Berkeley's rejection of determinism is structurally similar. Indeed, while determinism holds that phenomenal changes (ontologically) depend only on the way the laws of Nature apply to the previous conditions of the states of the world, the three philosophers all argues for the claim that the laws of Nature are not independent on the mind (the Hypostasis of (...) Soul or the Divine Mind). That is to say: laws of nature are not mechanisms producing the succeeding of one event to the others, namely are not properties of a non mental substance. Rather, they are regularities (ontologically dependent on the mind, since) established by a Mind. Plotinus, Leibniz and Berkeley hold a two steps argument: a) laws of nature aren't properties of a material substance accounting for phenomenal changes, since undifferentiated matter doesn't exist; b) even if regularities in phenomenal changes could be refer to properties of a substance, these regularities couldn't be construed as non mental mechanisms, because any transition from, say, event A to event B, lacks causal power. La educación patrimonial activista propicia espacios para la construcción de una ciudadanía comprometida, alimentando un sentimiento de pertinencia sociocultural en el entorno. Para ello, las autoras presentan algunas propuestas didácticas llevadas a cabo en las facultades de educación de la Universidad Rovira i Virgili y la Universidad de Barcelona para sensibilizar al futuro profesorado de la escuela infantil y primaria sobre la perspectiva de género, la coeducación y el pensamiento crítico. En el presente artículo se conceptualiza la educación patrimonial activista, (...) y se ofrece una línea-guía para promover la concienciación individual, socio-colectiva e intercultural en el alumnado y su profesorado, reconocidos como una comunidad educativa que incorpora los lugares patrimoniales como espacios co-creativos y participativos. Se concluye haciendo énfasis sobre la importancia de una educación patrimonial que promueva el activismo cívico, alternativa a una representación icónica y estática de los bienes culturales. (shrink)
